30-Day Conditional Return Policy

Available on Eligible Used Retail Vehicles Only

Da Vinci Automotive offers a 30-Day Conditional Return Policy on certain qualifying used retail vehicles. This policy is intended to provide added confidence for eligible purchases, especially for customers completing a purchase online or from out of state.

Not all vehicles qualify. Return eligibility is determined on a vehicle-by-vehicle basis and must be confirmed in writing in the signed transaction documents.

The signed 30-Day Return Policy – Eligibility Disclosure, Customer Acknowledgment, and Conditional Return Terms, together with the signed purchase documents, controls whether a specific vehicle qualifies and the exact terms that apply.

No Automatic Right to Cancel

Florida law does not provide a “cooling-off” or automatic cancellation period for vehicle purchases.

Unless a vehicle is marked eligible for Da Vinci Automotive’s 30-Day Conditional Return Policy in the signed transaction documents, the sale is final except for rights that cannot legally be waived.

Website statements, advertisements, summaries, or general descriptions of the return policy do not create a return right for vehicles that are not marked eligible in writing.

Which Vehicles May Qualify?

A vehicle may qualify only if it is a qualifying used retail vehicle with a vehicle selling price/cash price of $30,000.00 or more, before tax, tag, title, registration, dealer/documentary fees, shipping or delivery charges, finance charges, and optional products.

Basic Return Conditions for Eligible Vehicles

If a vehicle is marked eligible, the vehicle must satisfy all written return conditions, including:

Merely giving notice, scheduling transport, or placing the vehicle with a carrier within the 30-day period does not complete a return. The vehicle must be physically received by Da Vinci Automotive, or another location approved by Da Vinci Automotive in writing, within the return period.

Fees, Charges, and Deductions

A return is not free of charge.

If an eligible vehicle is accepted for return, the following charges may apply:

If deductions exceed the amount otherwise refundable or payable to the customer, the customer must pay the balance due before the return is completed.

Out-of-State and Shipped Vehicles

For shipped, delivered, or out-of-state vehicles, the customer is responsible for arranging and paying for return transportation unless Da Vinci Automotive agrees otherwise in writing.

The vehicle and all risk of loss or damage remain the customer’s responsibility until Da Vinci Automotive physically receives, inspects, and accepts the vehicle in writing.

Trade-In Vehicles

If a customer traded in a vehicle and an eligible return is accepted, Da Vinci Automotive may return the trade-in only if Da Vinci Automotive still possesses the trade-in and the trade-in has not been sold, transferred, titled, wholesaled, transported, reconditioned, paid off, encumbered, or materially changed.

If the trade-in cannot be returned, Da Vinci Automotive’s obligation is limited to the written trade-in credit shown on the purchase documents, subject to any applicable payoff shortage, negative equity, title issue, lien issue, undisclosed condition issue, missing equipment, or other amount owed by the customer.

Financing and Optional Products

If the vehicle was financed, any accepted return is subject to lender requirements, payoff, lien-release, and funding procedures. Da Vinci Automotive does not guarantee that a lender will unwind, reverse, or modify the financing contract.

The customer remains responsible to the lender until the financing is unwound, paid off, or otherwise resolved.

Optional products, including service contracts, GAP, appearance products, protection products, and similar products, are cancelable only according to the terms of those product contracts. Refunds may be paid to the lender where required.

Pre-Purchase Inspection

Customers are welcome and encouraged to obtain a pre-purchase inspection before shipment or purchase, at the customer’s expense and subject to Da Vinci Automotive’s reasonable inspection and transportation procedures.

For certain vehicles, Da Vinci Automotive may require any offsite inspection to be performed only at a manufacturer-authorized dealership or another Da Vinci Automotive-approved facility.

Warranty Status

The return policy does not create a warranty, service contract, repair obligation, or guarantee of vehicle condition.

Warranty coverage, if any, is controlled by the FTC Buyers Guide displayed with the vehicle and any separate written limited warranty or service contract delivered to the customer. If the Buyers Guide states the vehicle is sold AS-IS, no dealer warranty applies unless a separate written warranty says otherwise.
